This Privacy Policy describes how WAILY LLC (“Waily,” “we,” “us,” or “our”) collects, uses, and shares information when you use the Waily mobile application and related services (the “App”).
By using the App, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the App.
1. Information We Collect
Information you provide to us. When you use Waily, you provide information including:
• Details about your training (workout type, timing, intensity, and related notes)
• How you feel and other context you enter to receive nutrition guidance
• Meals and food information you enter to receive adjustments
• Account information such as email address
• Any other information you choose to enter into the App
Information collected automatically. When you use the App, we may automatically collect:
• Device information (device type, operating system, app version)
• Usage information (features used, actions taken, session length)
• General analytics
Subscription and payment information. Subscriptions are processed by the Apple App Store [and Google Play]. We do not collect or store your payment card details; those are handled by Apple [and Google] under their own privacy policies. We may receive confirmation of your subscription status.
2. How We Use Your Information
We use the information we collect to:
• Provide the App’s core function: generating personalized nutrition, hydration, and timing suggestions based on the information you enter
• Operate, maintain, and improve the App
• Respond to your questions and provide support
• Understand how the App is used so we can improve it
• Comply with legal obligations and enforce our terms
3. How Your Information Is Shared
We do not sell your personal information.
We share information only as follows:
Service providers. We use trusted third-party service providers to operate the App. This includes:
• AI / language model providers. To generate your nutrition adjustments, the training and meal information you enter is processed by third-party artificial intelligence service providers including OPEN Ai. These providers process your inputs to return a response and are contractually restricted in how they may use that data.
• Infrastructure and hosting providers that store data and run the App
• Analytics providers
Legal requirements. We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Waily, our users, or others.
Business transfers. If Waily is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
4. Data Retention
We retain your information for as long as your account is active or as needed to provide the App, and thereafter as necessary to comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion of your data as described below.
5. Your Choices and Rights
You may:
• Access, correct, or delete information you have entered, within the App or by contacting us
• Request deletion of your account and associated data by contacting us at ryker@wail.app
• Stop providing information by discontinuing use of the App
Depending on where you live (for example, California or the European Economic Area), you may have additional rights under laws such as the CCPA/CPRA or GDPR, including the right to access, correct, delete, or restrict processing of your personal information, and the right to lodge a complaint with a supervisory authority. 6. Health-Related Information
Waily is a general fitness and nutrition tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Information you enter about your training and how you feel is used only to generate general nutrition guidance. We do not knowingly use this information for any purpose other than operating the App. You should consult a qualified professional before making significant changes to your nutrition or training.
7. Children’s Privacy
The App is not directed to children under 13, and we do not knowingly collect personal information from children under that age. If you believe a child has provided us information, contact us and we will delete it.
8. Security
We take reasonable measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. International Users
Waily is operated from the United States. If you use the App from outside the United States, your information will be processed in the United States, where data protection laws may differ from those in your country.
10. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new “Last updated” date, and material changes may be communicated through the App.
